The following is the Privacy Policy of Active Psychotherapy and applies for the content of www.activepsychotherapy.ca ("site"). We are committed to keeping your personal information safe. This policy serves to inform you of your rights regarding the collection, use, and disclosure of your personal information consistent with British Columbia's Personal Information Protection Act (PIPA).
The information contained within this policy and terms of use applies to anyone who has accessed this website, voluntarily submitted correspondence through the "Contact" page, or who is a current or past client of Active Psychotherapy.
This statement also provides information about how you can access your personal information, and how your personal information is being used by the organization.
In British Columbia, PIPA is the relevant legislation that applies to the practice of counselling and psychotherapy, the use of this site, and information that is shared with Active Psychotherapy and collected on a voluntary basis. As such, all identifiable information collected by counselling professionals about an individual, in the course of a request of consultation, visiting the site, and throughout the course of treatment is considered "personal information" under the Act.
Defined in PIPA, this refers to "information that can identify an individual" and "information about an identifiable individual" which includes: your name, email address, mailing address, phone number, or information about the electronic device used to access this site (such as IP address, whether you're on a mobile device or personal computer, and geographical region the device is from).
Contained within this Policy includes:
Active Psychotherapy collects your personal information only directly from you, except when you have provided consent to obtain such information from others (e.g. sharing a previous assessment report with your counsellor); and where the law requires or allows us to collect information without your consent (e.g. in an emergency, when information is needed to prevent or mitigate potential imminent harm).
Active Psychotherapy collects information from you only that is believed to be needed to: (i) assess and provide you with the services requested or make referral(s) to appropriate services; (ii) to maintain contact with you for service-related or future consent purposes; (iii) to prevent or offset harm (e.g. requesting an emergency contact phone number). The collection of information from you for any other purpose will only be done with your informed consent.
By law and through accordance with BCACC (British Columbia Association of Clinical Counsellors), counsellors are required to keep and maintain a record of services provided to and contacts with you. This record contains information you provide or authorize Active Psychotherapy to receive, results of any assessments, your treatment plan, consent forms, contact notes, progress notes (counselling notes), billing information, and correspondence sent to or received relating to your counselling service. The physical records are the property of Active Psychotherapy. You have rights regarding access to your record and regarding disclosure of information from your record.
If you are the custodial parent or guardian of a child receiving service, you may not access (without the child's consent) the personal health information of a child, who was deemed a "mature minor" who is able to consent to the service on his/her/their own.
Active Psychotherapy has an encrypted contact form for parties interested in arranging a 15-minute consultation with Frazer Bucholtz, M.Ed, RCC #23101 to determine whether Active Psychotherapy is a suitable service for them.
This contact form asks for name, email address, and phone number so that Active Psychotherapy can contact potential clients by email to arrange a time for a phone-based consultation. Persons choosing to submit this form are doing so on a voluntary and informed basis consistent with the Terms of Use and Privacy Policy.
Frazer Bucholtz, of Active Psychotherapy, returns all client email-led requests for consultation(s) by email; if you want to make arrangements for a consultation by phone, please contact him directly at 236-704-6989. Please note this number does not receive text messages.
If it has been mutually established and agreed upon during the consultation that Active Psychotherapy is suitable for the prospective client, Frazer Bucholtz will offer an appointment schedule by phone or email. Client names, email addresses, and brief, relevant information regarding counselling services rendered are collected and recorded in compliance with BCACC's record keeping policy electronically in Jane.App, a secure (Canadian-based) PIPA/PIPEDA compliant online practice management system.
Your personal information may be used by Active Psychotherapy to: provide counselling/psychotherapy services to you, respond to phone calls, emails, or provide resources to support your therapy experience, to arrange and conduct free 15-minute phone consultations, to schedule therapy sessions together, and to contact you when you reach out requesting to initiate counselling/psychotherapy services.
At the time of establishing and agreeing upon a therapeutic relationship between the prospective client and Frazer Bucholtz, of Active Psychotherapy, the client will be requested to provide on a voluntary basis:

Any information you choose to share regarding your personal situation, past or present, is for the purpose of providing counselling and collaborating with you on a treatment plan. Information shared in the course of counselling is kept strictly confidential with exceptions outlined in the informed consent form at the onset of our working relationship. A few limits to confidentiality exist within counselling, detailed below under Confidentiality.

This site contains the "Book My Free Consultation" contact form, which prospective clients can voluntarily consent to submit personal information through, for purposes of arranging a 15-minute consultation.
Activepsychotherapy.ca does not actively collect personal and identifiable information about clients or potential clients, except if clients or potential clients opt to provide this information through the web form. Information provided through the secure web form is submitted by clients on an informed, voluntary, and consensual basis. While the website collects analytics, these are not personally identifiable to Active Psychotherapy. These analytics may include: popular webpages, search terms, browsers, operating systems, and devices used (e.g. mobile device or personal computer).
Some clients may opt to pay for therapy sessions through the use of e-transfer, while others may choose to use Jane Payments, a secure payment portal through their Jane.App profile. No credit card information is stored in Jane Payments. When credit card information is entered into Jane, Jane Payments creates and keeps an encrypted token that can be used to reference that information; the actual sensitive information is sent to and stored within their payment partner, Stripe, which holds the highest security certification in the industry. At the time of initializing services, or at any point during your services with Active Psychotherapy, you may opt to change your billing preferences.
Please note that email is not considered a secure and confidential way of communicating sensitive information. For the protection and safeguarding of your privacy, please do not email information in the "Book My Free Consultation" form that you would not be comfortable discussing in a public space.
Frazer Bucholtz is committed to confidentially discussing your concerns either in session, via the Jane.App's secure video platform, or, if these concerns can be addressed in the process of a 15-minute free consultation these may be discussed by phone.
Any email or phone exchanges are part of the personal record.
Active Psychotherapy requires phone-based consultations and telehealth (virtual therapy) appointments to be attended by you from a private and confidential space. At the onset of each correspondence by phone or telehealth, your therapist will confirm that you are in a private space deemed appropriate for counselling/therapy. If deemed unsuitable, an alternative time will be suggested. For follow-up appointments, please note that joining from an inappropriate space (e.g. a coffee shop, on public transit) will result in a late-cancellation/no-show fee per the cancellation policy.
The Active Psychotherapy counselling office operates from a single-use room located in Burnaby, B.C., with a door that is closed during sessions and when working with any form of confidential information. The room is situated in a private area, and in-ear headphones are used for all phone and video sessions so that clients' voices are never broadcast beyond the direct intended recipient, Active Psychotherapy. Any confidential client information or documentation is locked when not in use or stored on a password-protected, secure computer.
At the outset of engaging in counselling/psychotherapy services, and as part of informed consent, Frazer Bucholtz, M.Ed, RCC #23101, representing Active Psychotherapy, will provide information regarding the limits of confidentiality, and review and obtain verbal and written consent (electronically distributed and signed via the Jane.App intake form(s)).

Clinical Counsellors provide information at the outset of services and as part of informed consent regarding further limits to confidentiality beyond the universal and minimally expected limits noted above.
Active Psychotherapy has implemented appropriate technical and storage controls to protect your personal data. Although all possible appropriate safeguards are in place, sending information, including personal information, via the internet is not completely secure. While Active Psychotherapy does our best to protect your personal data, we cannot guarantee the security of any personal information sent to our site while still in transit (online), and thus it is implied that you provide this information at your own risk.
Active Psychotherapy is not authorized to disclose your personal information to any third party without your express written and signed consent (through a release of information form), except in emergency situations where there is only time for you to provide and authorize verbal consent. With only a few exceptions, outlined under Confidentiality, your personal health information will not be disclosed to persons outside of Active Psychotherapy without your knowledge and express consent. The exceptions are circumstances in which disclosure is allowed by law.
Active Psychotherapy cannot and will not respond to requests from concerned family members, friends, or employers about a client's attendance, disclosure in session, whether services have been rendered, or whether someone is a recipient of counselling services from Active Psychotherapy.
Limited exceptions exist, such as where in provision of counselling to a minor who has provided limited consent to information sharing to third parties such as a parent or guardian of: appointment time(s), receipt(s), and if requested by the client to have Active Psychotherapy correspond with third parties with explicit consent regarding the content(s) and purpose of disclosure.
There are limits to confidentiality which involve mandatory disclosure to third parties, detailed in the client informed consent and Confidentiality section above.

The Terms of Use are governed by and construed in accordance with the laws applicable in the Province of British Columbia, without giving effect to its conflict of law provisions. You agree that you will bring any claim or cause of action arising out of your use of the site to the courts located in the Province of British Columbia, and you also agree to submit to the personal and exclusive jurisdiction of those courts. If there is any dispute between you and Active Psychotherapy regarding or involving this agreement, the site, or the services, you hereby agree that the dispute will be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without its conflict of law provisions. If any provision in these terms is determined unenforceable, then such provision will be severed and replaced with a provision that most closely reflects the intent of the original provision, and the remaining provisions of these terms will remain in full force and effect. The terms and agreement as a whole will not be deemed unlawful, void, or unenforceable, but only that portion of the agreement found unlawful, void, or unenforceable will be stricken from the terms.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Active Psychotherapy as a result of these terms and/or your use of this site. You may not assign any right, interest, or benefit provided under these terms or through the site without express prior written consent by Active Psychotherapy.
